Reduce Health Care Cost.....

Question: We are looking for ways to reduce our costs for Health Insurance. We would like to charge an employee a higher percent of the premium for family coverage if the employee’s spouse is eligible to obtain coverage from the spouse’s employer, but our employee instead uses our plan. Do you see a problem with that?

Answer: That depends on what type of plan you have. Beware, if you have a self-insured plan. Section 105 of the Internal Revenue Code prohibits discrimination in self-insure plans in favor of highly compensated employees. If you find that your new policy penalizes those at the lower end of your compensation scale, you may have an issue. If your plan is not self-insured, you should not run into any issues under the Internal Revenue Code based on that policy, although you may create an employer-employee relationship problem.
